Terms of Service
These Terms of Service ("Terms") govern your use of the website consensusprotocol.org and the GPU cloud and AI inference services (the "Services") provided by Consensus Protocol LLC ("Consensus Protocol," "we," "us"). By using the Services, you agree to these Terms.
1. The Services
Consensus Protocol provides compute infrastructure, including an AI inference API served from dedicated GPU hardware that we operate. Access to the inference API may be provided directly or through third party routing platforms such as OpenRouter. When you access the Services through a routing platform, that platform's own terms also apply to your relationship with it, including account management and billing.
2. Acceptable Use
You agree not to use the Services to:
- Violate any applicable law or regulation
- Generate, process, or distribute child sexual abuse material or any content that sexualizes minors
- Infringe the intellectual property or privacy rights of others
- Attempt to probe, scan, breach, or circumvent security or authentication measures
- Interfere with or disrupt the integrity or performance of the Services, including through denial of service attacks or resource abuse
- Resell or redistribute the Services in a manner that misrepresents their origin
We may suspend or terminate access for violations of this section without notice.
3. Service Availability
We work to keep the Services reliable, but they are provided on an "as is" and "as available" basis. We may impose rate limits, return capacity errors, or perform maintenance at any time. We do not guarantee uninterrupted availability, specific latency, or specific throughput unless separately agreed in writing.
4. Content and Data
You retain all rights to the content you submit to the Services. We process inference content only as necessary to deliver responses, as described in our Data Policy and Privacy Policy. You are responsible for the content you submit and for ensuring you have the rights necessary to submit it.
5. Disclaimer of Warranties
To the maximum extent permitted by law, the Services are provided without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non infringement. Output generated by AI models may be inaccurate, and you are responsible for evaluating it before relying on it.
6. Limitation of Liability
To the maximum extent permitted by law, Consensus Protocol will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data, arising from or related to the Services. Our total aggregate liability for any claim arising from the Services will not exceed the greater of one hundred US dollars or the amounts paid to us for the Services in the three months preceding the claim.
7. Indemnification
You agree to indemnify and hold harmless Consensus Protocol and its officers, employees, and agents from claims arising out of your use of the Services in violation of these Terms or applicable law.
8. Governing Law
These Terms are governed by the laws of the State of Florida, United States, without regard to conflict of law principles. Any dispute will be resolved in the state or federal courts located in Collier County, Florida.
9. Changes to These Terms
We may revise these Terms from time to time. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
